Czech watchdog rejects Westinghouse, EDF appeals over KHNP nuclear deal

SEOUL, November 1 (AJP) - The Czech antitrust watchdog has dismissed appeals from U.S.-based Westinghouse Electric Co. and French state-owned utility EDF against Korea Hydro & Nuclear Power (KHNP) being chosen as the preferred bidder for a nuclear power plant project.

The Czech Office for the Protection of Competition (UOHS) has been reviewing objections the two failed bidders filed after KHNP was named the preferred bidder in July to build new reactors in the Dukovany nuclear power plant in the Czech Republic, valued at about 24 trillion won (US$17.3 billion).

“The proceedings on the proposals from both companies were largely terminated, while other parts of the proposals were rejected,” UOHS said in a press release on Thursday. The agency added that both companies may appeal the decision again.

Westinghouse and EDF had challenged KHNP's selection, citing concerns over the alleged inability to fulfill the contract and violations of public procurement principles. UOHS rejected the claims, noting a lack of standing and missed deadlines for certain objections.

The previous day, the antitrust office had temporarily blocked the government from signing a contract with KHNP pending the review. The office stated it would maintain this measure until the appeals process is complete.
